Recently, the Parliament passed the three new Criminal Laws:
- The Bharatiya Nyaya Sanhita, 2023 (Act 45 of 2023) (Replacing the Indian Penal Code, 1860)
- The Bharatiya Nagarik Suraksha Sanhita, 2023 (Act 46 of 2023) (Replacing the Code of Criminal Procedure, 1973)
- The Bharatiya Sakshya Adhiniyam, 2023 (Act 47 of 2023) (Replacing the Indian Evidence Act, 1872)
The new laws are aimed to revamp and overhaul the system of criminal justice administration across the country. While certain new offences have been incorporated on the one hand, on the other, new forms of punishment have been introduced keeping in consideration the changing realities. Also, policing and investigative mechanisms have been revamped with focus on advancements in technology and forensic science.
The present book aims to provide the judicial officers, advocates, students and other legal professionals a comprehensive analysis of the new criminal laws. Comparative tables have been incorporated so as to give a quick and easy reference to the earlier and the corresponding new laws. Comments have been added along with the statutory provisions for a clear understanding. Relevant and landmark case-laws have also been incorporated in the text.
It is earnestly hoped that the book serves the legal fraternity with basic, clear and concise knowledge of the new criminal laws. Inadvertent errors, if any, are regretted and would be corrected in future editions.
